NC Redistricting Update- June, 2022
The battle is moving to the Supreme Court with national ramifications
The Supreme Court (June 30, 2022) agrees to hear Moore vs Harper case that may give states legislatures independent power over elections and undermine our democratic processes.
Tim Moore, the NC Speaker of the House, submitted an appeal of the NC Supreme Court decision (see below) to the U.S. Supreme Court. The U.S. Supreme Court agreed to hear the case during their next session. The appeal is based on a right-wing theory called the “independent state legislature” theory. It is an extreme reading of the constitution that proposes state legislatures alone have the power to regulate federal elections in their states. There would be no judicial review. Legislators would have unfettered election authority. There would be no review of gerrymandered districts. The will of the people would be undermined and subjected to minority rule. Four of the U.S. Supreme Court justices have signaled support (Alito, Gorsuch, Kavanaugh, and Thomas). Our voting rights and our democracy are on the line.
Implications for NC
If the Republican redistricting map that was rejected by the NC Supreme Court is allowed to go into effect in 2024 then it is predicted that the Republicans would have an 11-4 advantage in the U.S. House NC delegation. In addition, our state legislature under Republican control might decide to select their own Presidential electors in 2024; thus, going against the will of the voters.
We need to get out the vote for our NC State Senate candidate, JAY CAREY. The Republicans in the NC State Assembly are 2 State Senate seats and 3 State House seats away from having a super-majority where they can override the governors veto. (Note: There is no Democratic Party candidate for NS House.) We must do our part to stop this from happening.
We need to get out the vote for CHERI BEASLEY for U.S. Senate (for many reasons). If we can retain control of the Senate with at least 2 more Senators (to negate the Manchin-Sinema impact) there can be favorable decisions about the filibuster, voting rights legislation, and consideration of adding more justices to the Supreme Court. This can help negate a possible Supreme Court decision.

New State House & Senate, and U.S. Congressional Districts Set
The 3-judge Superior Court panel approved the NC Assembly submitted state house and senate districts judging them as constitutionally fair.. The panel ruled that the submitted redrawn U.S. Congressional map was still not fair and approved their modified version that was developed with support from consultants including nonpartisan experts. NOTE: The Congressional map is an interim one to be used for the 2022 election and the General Assembly could redraw the map to be used in 2024. The state Supreme Court denied appeals that were submitted by all four parties involved (Democrats concerned with NC Senate Districts; Republicans concerned with the U.S. Congressional district maps). The defendants have an option to appeal to the U.S. Supreme Court.
Impact on Polk NC Dems: The primary election dates in the table below are in effect with May 17th being primary election day. We are now in a new U.S. Congressional District 11; N.C. House District 113; and N.C. Senate District 48. The last week of candidate filing started on February 24th at 8am. NC Redistricting Update- February 4, 2022
NC State Supreme Court rules gerrymandered districts unconsitutional
On February 4, the State Supreme Court determined that the Republican-led redrawing of political districts in NC was unconstitutional. The vote was 4-3 with all Republican-appointed justices dissenting. New districts (both State Assembly and U.S. House) must be submitted by February 18 and then the court will have until February 23 to decide. The Republican-led state legislature as well as all other parties involved in the law suit can submit proposed replacement maps to the 3-judge trial court that originally heard the case. In their original decision, the Republican-majority appointed trial court decided that the original redrawn districts were fine.

Current Status of NC Redistricting (as of January 25, 2022)
The NC Republican-led General Assembly passed legislation that heavily gerrymanders districts in favor of Republicans following the 2020 census. This impacts NC General Assembly districts as well as congressional districts. A panel of 3 Superior Court judges ruled on a suit against the redrawn districts in favor of the Republicans. The case is headed to the NC Supreme Court.
The redrawn districts will have a lasting 10-year impact until the next census.
The impact for Polk County: Primaries are moved back to May 17th (although Republicans are trying to get this moved back further, stay tuned). There is one more week for local candidates to file to run for office that is pushed back to February 24 - March 4 (noon). We cannot be sure which voting districts we are in. For now we are in the newly formulated Congressional district 13. (see press release about NC Supreme Court suspending candidate filing and moving primary date.)
